RELEASE OF LIABILITY AND ASSUMPTION OF ALL RISKS (“Release”)
I would like to attend the event known as "Boulder DeCompression 2025: The Dust Off" (the “Event”), being hosted by Art in Community, Inc. I agree to take personal responsibility for my actions or inaction and safety, as well as responsibility for any minors I may bring, at all times. I understand that while AiC and Roots have put in certain safety measures, I also understand certain risks are nevertheless present at the Event, including (but not limited to):
hazardous terrain, including but not limited to low visibility at night; uneven terrain, trip hazards, vehicles parked in lots, high altitude; cold climate and weather; equipment and infrastructure constructed by other Event attendees; equipment, furniture and decor on-site; limited supervision; the presence and consumption of alcohol and other intoxicants; the availability (or lack thereof) of medical facilities and/or assistance; use of fire; and possible adult themes and/or nudity.
I ALSO ACKNOWLEDGE AND ASSUME ALL RISK RELATED TO THE POTENTIAL PRESENCE OF PARTICIPANTS WITH THE COVID-19 VIRUS, INCLUDING THE DELTA, OMICRON AND OTHER VARIANTS. I understand that it is my responsibility to keep myself safe through generally accepted practices such as wearing a mask, watching hands, social distancing, and opting not to attend if I am symptomatic. I acknowledge that neither AiC nor Roots will conduct or require COVID-19 testing and/or proof of vaccination as a requirement for entry into the Event. I further acknowledge that I am assuming all risk of COVID-19 transmission VOLUNTARILY by attending the Event and that AiC and Roots are not responsible in any way to prevent the possible transmission of COVID-19 at the Event.
I knowingly assume the risk of injury to my person or property, including permanent disability and death, due to these risks, whether specifically identified to me or not. Neither AiC or Roots, MANAGE AND THEY CANNOT GUARANTEE THE SAFETY OF ANY INFRASTRUCTURE, ART, OR ACTIVITY PERFORMED, CONSTRUCTED, OR OFFERED BY OR WITH THE ASSISTANCE OF EVENT PARTICIPANTS. AiC and Roots also cannot guarantee the absence of any of the previously listed risks and dangers. I have been informed of these risks and understand all rules of participation in the event. I am responsible for reading, understanding and complying with all signage, including instructions provided at the entry gate to the Event and instructions from any Event volunteers or organizers.
I assume all responsibility for loss or damage to equipment or personal property, and understand that no reimbursement will be made by AiC or Roots, in the event that equipment or personal property is lost, stolen or damaged. I understand that my ticket is a revocable license that may be revoked by AiC or Roots in the event that I fail to follow any posted instructions or instructions received from designated Event representatives. I appoint AiC and Roots as my representative to take actions necessary to protect my intellectual property or privacy rights, recognizing that AiC and Roots have no obligation to take any action whatsoever. I agree that commercial use of recordings and images taken at the Event is prohibited without the prior written consent of AiC and Roots, and that AiC and Roots may use images and recordings from the Event (which may include me and my likeness) for commercial or non-commercial purposes. I agree to hereby waive any claim for financial, equitable or any further compensation or damages from AiC or Roots arising from their use of my voice, image, or likeness.
